These are the terms and conditions of the Parents’ Association of Children with Tumours and Leukaemia (“PACT”), whose registered office is at Sheffield Childrens’ NHS Trust, Sheffield Childrens Hospital, Western Bank, Sheffield, S10 2TH, Charity No. 508412.

Please read these terms carefully as they set out the basis on which you are allowed to use this website, pactfriends.co.uk, (“the Site”) and the information contained within it. They protect you as a user of the Site and prevent the Site from being used for any illegal or unauthorised purposes. By using the Site you agree to be bound by these terms and conditions.

1. Information on our Site

1.1 Most information on the Site is provided to PACT by third parties and is therefore provided on an as is basis. We do our best to ensure that the information on the Site is accurate at all times. However, we cannot ultimately warrant the accuracy or completeness of any of the information or its fitness for purpose and cannot be held liable for any use or reliance you may make of or put on it.

2. Your use of our Site

2.1 You may only use this Site for lawful purposes. You must not under any circumstances seek to circumvent the security of the Site or any information available through it. In particular, but without limitation, you must not seek to access, alter or delete any information to which you do not have authorised access, seek to overload the system via spamming or flooding, take any action or use any device, routine or software to crash, delay, damage or otherwise interfere with the operation of this Site or attempt to decipher, disassemble or modify any of the software, coding or information comprised in the Site./p>

3. Our liability

3.1 As a substantial amount of information is provided by third parties, PACT shall not be liable for the accuracy, completeness or appropriateness of any information on the Site. It is your responsibility to satisfy yourself that any information which you use from the Site is suitable for your own particular purposes. You assume full responsibility for using any information on the Site and you understand and agree that if you use or rely on information neither PACT nor its employees are responsible or liable for any claim, loss or damage arising from such use or reliance. We do not represent or warrant that the information accessible via this Site, is accurate, complete or current nor that this Site or server will be available, accessible, uninterrupted, timely, secure or operate without error or that it will be free from viruses, bugs or other harmful elements.

3.2 We will not be liable for any loss, damage, expense, cost, delay or other liability whatsoever (including without limitation any financial loss such as loss of profit) which you may incur as a result of any event beyond our reasonable control (including without limitation any failure of transmission, communication, computer or other facilities or your inability to access the Site for any reason or any failure, error or delay in the sending or receiving of any notice or communication or instruction through the post or any electronic medium).

3.3 Nothing within these conditions operates so as to exclude, limit or restrict our liability for death or personal injury.

3.4 You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of these terms by you or your use of the Site.

4. Copyright and other intellectual property

4.1 All intellectual property rights and goodwill in or relating to the contents of the Site belong to either PACT or to the third parties that contribute to the Site’s content.

4.2 Nothing contained in these conditions or the Site should be construed as granting by implication, estoppel or otherwise, any licence or right to use any of the trade marks on the Site without our permission. However, copying and printing of those web pages which contain the trade marks is permitted within the scope of the licence contained below.

4.3 You may download to a local hard disk and print extracts from the Site solely for personal, non-commercial use. You may also recopy downloaded extracts to others for their personal, non commercial use.

4.4 You may not reproduce part or all of the contents of the Site in any form without our prior written permission, unless it is for personal, non commercial use.

4.5 You may not reformat or otherwise change part or all of the contents of the Site so as to affect the copyright of PACT in the information, nor merge the same so that the information ceases to be readily identifiable as that of PACT.

5.1 A number of links to other websites are included in the Site. Such links do not imply any endorsement of any products, services, information or material offered or accessible on, or of any person connected with, any such other website. The content of such linked websites is beyond the control of PACT. The links are provided for information only with no warranty, express or implied, as to any aspect of those websites. PACT shall not be responsible or liable for any damages or in any other way in connection with the linking.

5.2 You may not frame or link to the Site or any part of it without our express permission.

6. Changes to terms and conditions

6.1 We reserve the right to change the terms and conditions under which the Site is offered at any time. Any such change in terms and conditions will be effective once published on the Site via a link.

7. Severance

7.1 If part, or all, of these terms and conditions become void the remaining part of them and any other provisions on the Site which shall form part of these terms and conditions will remain valid and enforceable.
